We know that every case is different, and every client has their own specific needs. We use our experience to get to the truth of the matter and to communicate openly and honestly with our clients. Our goal is not just to provide a satisfactory outcome for our clients, but to also provide complete transparency in all aspects of representation.

INVESTIGATION

The first step in any matter is the investigation. Sometimes this is as simple as a client interview or a meeting with the client’s family. Sometimes it involves getting boxes of legal documents, then digging through them to get a complete understanding of a complex situation. And sometimes it involves going through dozens of hours of video to find those 15 seconds that make or break the case. No matter what the issue, we want to learn as much as we can.

RESEARCH

Legal issues can be complicated, especially when a case is headed toward trial. When something is clear-cut, we will tell you. But when it isn’t, we will do everything we can to understand all the possibilities. Our lawyers have researched and written hundreds of motions and briefs, and argued appeals in the New York Supreme Court Appellate Term and Appellate Division.

OUR ATTORNEYS

ARTHUR BERNARDON

Arthur was an Assistant District Attorney at the Westchester District Attorney’s Office for five years before forming Tobin & Bernardon LLP. While in the Westchester County District Attorney’s Office, Arthur handled upward of one-thousand cases each year, argued in the New York Supreme Court Appellate Division — Second Department, tried over half a dozen Jury Trials to verdict, and has prosecuted upwards of fifty Non-Jury Trials and dozens more adversarial hearings.

 

While working for the Westchester County District Attorney’s Office, Arthur was given the unique role of handling all Local Court Domestic Violence cases for the City of Mount Vernon.  While in that role, Arthur was personally responsible for hundreds of family-related cases from investigation all the way to trial. It was in this role that Arthur developed a keener understanding for communicating with families, investigating issues, and resolving difficult family matters to get the best outcome for the victims in his cases.

Arthur is also a former prosecutor for the Village of Port Chester, and a current prosecutor for the Village of Mamaroneck, where he prosecutes vehicle and traffic violations for the village.

JAMES P. TOBIN 

James was an Assistant District Attorney at the Westchester District Attorney’s Office for five years before forming Tobin & Bernardon LLP. He worked on thousands of cases in his tenure at the DA’s office, including high-profile homicides, sex crimes, and violent felonies. James has tried dozens of cases and participated in innumerable hearings, but his main focus has always been on legal research and writing.

 

Prior to joining the Westchester District Attorney’s Office, James interned for the Massachusetts Sentencing Commission and the Committee for Public Counsel Services (Massachusetts’ public defender organization).

 

James also worked for Harpo Films, Oprah Winfrey’s film production company, as a story analyst before pursuing law. James uses the story-telling techniques he honed in entertainment to effectively communicate with judges, juries, clients, and adverse parties.

James is also a former prosecutor for the Village of Port Chester, and a current prosecutor for the Village of Mamaroneck, where he prosecutes local ordinance and building code violations for the village.

ELIZABETH J. WAZNY

Prior to joining Tobin & Bernardon, LLP, Elizabeth began her career as an Assistant District Attorney for the Westchester County District Attorney’s Office in their Motions Bureau. She then went on to the Rockland County District Attorney’s Office where she practiced as a Senior Assistant District Attorney in their Special Victim’s Unit. There, she investigated and prosecuted felony sexual abuse and assault cases, domestic violence cases and child abuse cases. Her responsibilities included handling all matters before the Integrated Domestic Violence Court. This court is a specialized Supreme Court Part where victims of domestic violence and their families appear before one judge to resolve their criminal, family and matrimonial matters. Elizabeth then went on to private practice where she represented clients in areas of family and matrimonial law including divorce, custody and visitation, child support, alimony/maintenance, and post judgment matters. 

 

Elizabeth has extensive courtroom litigation experience and specialized training including being certified by New York State in child forensic interviewing. She has always had a passion for arriving at a just result by utilizing understanding, creativity and zealous advocacy. She is also a member of the Westchester Women's Bar Association and a member of the National Association of Divorce Professionals in their NYC Midtown Chapter.

Elizabeth is also a prosecutor for the Village of Mamaroneck.
